1. PURCHASE CONTRACT
This web site is operated by City Warehouse Apartments Ltd ("we", "us" or "our"). By using the citywarehouseapartments.com website you are bound by these terms and conditions. All use and purchases made on this web site are governed by these Terms and Conditions at any time although the Terms and Conditions governing any given use or purchase will be those in effect at the date of your order or specific use. If you use or order goods after we have published any changes you will be bound by those changes. Accordingly, you should check prior to each use or order to ensure that you understand the precise terms and conditions applicable to your site visit or purchase. To assist you in determining whether the Terms and Conditions have changed since your most recent order we will display the date when these Terms and Conditions were most recently updated.
We operate a non-profit intermediary service between our guests and Swan Street Stores.
Any orders may be amended or cancelled by the customer at no charge, provided that this is done before the cut-off time stated on the order confirmation email or if none, as set out in clause 5 below. Any orders that have not been cancelled by this cut-off time are binding, and will be delivered by Swan Street Stores.
You must be 18 years old or over in order to participate in our service.
The law places certain restrictions on transactions involving alcohol, and accordingly alcohol must be either ordered by you or delivered by us during normal licensing hours.
2. PRICE AND DELIVERY CHARGES
The price of the goods will be as quoted on the web site at the time you confirm your order subject only to any inadvertent technical error for which we will not be liable. If you subsequently amend your order to add items, the prices charged for new products which were not in your original order will be the prices quoted at the time you confirm your amended order. However, if you add more of the same items which were in your original order, then the prices charged for these items will be the prices quoted at the time you confirmed your original order. Where a substitute item is offered in place of an item ordered, the price charged for that substitute item (if accepted) will be the price applicable at the time the item is substituted. Please note that as promotions are offered for a limited period of time subsequent amendments to your order may mean that certain promotions are no longer being offered.
All deliveries are free of charge and there is no required minimum order.
3. METHODS OF PAYMENT
Payment can be made via Paypal directly through the link on the City Warehouse Apartments website. Alternatively, you can pay by cash when you check in at City Warehouse Apartments. Payment by cheque is not accepted.
You agree to compensate City Warehouse Apartments in full against all reasonable costs, expenses and outgoings incurred in obtaining payments from you in the event a failed payment occurs. We may at any time after a failed payment has occurred ask a debt collection agency to collect payment from you.
4. DELIVERY
Products are subject to availability and prevailing market conditions. We may limit the quantities of goods (particularly goods on special offer) supplied to any one customer if in our opinion the quantity ordered jeopardises availability for other customers. In the event of non-availability of any goods you order, we may offer a reasonable substitute. This may affect the price you pay. You may reject any substitute item and we will refund the amount you have been charged for that substitute.
We will always try to supply you with the full quantity that you have ordered. If you are not satisfied with the quantity you have received we will arrange with you for non-perishable goods to be returned to us (please note that the goods must not be used and must be in good condition). In the event that the goods delivered to you are incomplete or include incorrect goods, you must notify us promptly. You will not be charged for any incorrect goods or goods which you have not received
Delivery upon arrival at City Warehouse Apartments cannot be guaranteed if you check in prior to 3pm.
Orders placed on the day of arrival are not able to be delivered and must be collected from Swan Street Stores.
5. AMENDMENT OF ORDERS AND CANCELLATION RIGHTS
You may cancel your order up to 48 hours prior to your arrival at City Warehouse Apartments without any charge. You agree to be charged for all perishable items if you cancel within the 48 hour period.
6. PRIVACY
We respect your privacy. The personal information that you give us is held with care and security. We do not sell, rent or transfer this information to third parties for their marketing purposes unless you agree otherwise.
7. GENERAL
If any of these Terms and Conditions is held by any court of competent authority to be unlawful, invalid or unenforceable, in whole or in part, this will not affect the validity of the remaining Terms and Conditions which will continue to be valid and enforceable to the fullest extent permitted by law.
These Terms and Conditions will be governed by English law and the parties submit to the exclusive jurisdiction of the English courts in relation to any dispute which may arise between them.
Hotel Bookings
- Check in time is after 3.00pm on the date of arrival. Check out is by 12 noon on the date of departure. We will always try to accommodate guests who arrive early, if rooms are available. Should we be unable to arrange an early check in, baggage may be left at the reception before check-in time, subject to availability.
- You will be supplied with up to two sets of keys upon arrival. On departure, we ask that the keys are returned to reception or placed in the key drop box in the lobby. Any keys not returned on the date of departure will be charged at a cost of up to £50 to cover the cost of changing the lock to the apartment and replacement keys.
- A security deposit of between £50 and £300 will be required on check in and must be pre-authorised on a debit or credit card. Keys will not be handed over without this deposit and the cost of the room will still be chargeable to the card that the reservation was secured under if you are unable to provide a debit or credit card on check in. Any damage caused, or breach of the terms and conditions of your booking may result in a deduction from your security deposit. Note that Irish Laser Cards are not accepted.
- You will be responsible for your apartment and the acts of all guests in your group during your stay at the hotel.
- All apartments will be freshly cleaned for your arrival with fresh bed linen and towels supplied. The apartment will be cleaned (and linen/towels replaced) on twice-weekly basis for stays of more than seven nights. You may also request more frequent cleans at an additional cost, or free replenishment of tea, coffee and milk etc directly with one of our reception staff.
- The apartments and all common areas of the hotel are non-smoking and smoking is not permitted anywhere in any apartment by law. Insofar as it becomes apparent that an apartment [or common area] has been smoked in, we will charge you an automatic fee of £50 for fumigation.
- No pets are permitted in the hotel, with the exception of guide dogs, which may be permitted with prior notice given to the hotel.
- Parcels and letters for guests may be delivered to reception, where they will be held safely.
- The apartments are located within or near residential areas of the city. We ask that you please respect other guests at the hotel and residents in the general location of the building by not creating or allowing excessive noise or unruly behaviour.
- Parties are strictly forbidden in any apartment or common area at any time. Breach of this condition may result in your removal from the property without refund and with loss of your security deposit.
- It is your responsibility to ensure that there is no damage caused to items within the apartment and that everything is kept in good working order during your stay. In the event that you notice any items in the apartment that are damaged or broken, please report them to us as soon as possible after gaining entry to your apartment.
- If any item is removed from the apartment on your departure, or damaged during your stay, you will be responsible for its replacement. Costs will be debited from the payment details supplied when booking/checking in.
- Damage caused to the apartment or any of its fixtures and fittings will be charged to you at the relevant rate, including any business interruption losses. Costs will be debited from the payment details supplied when booking/checking in.
- A booking does not create a lease or tenancy and the stay, by way of licence, will only be for the period and upon the terms detailed in the booking confirmation.
- Parking may be provided at the building in which your apartment is situated upon prior agreement with City Warehouse Apartments. Vehicles and their contents are left entirely at the owner’s own risk. City Warehouse Apartments accepts no responsibility for any loss or damage incurred.
- Personal effects and belongings are left in the apartment at the owner’s own risk. It is not advised to leave valuable items unattended. City Warehouse Apartments accepts no responsibility for any losses incurred.
- City Warehouse Apartments may, from time to time need access to the apartments to carry out routine maintenance tasks. We will ensure that the appropriate notice is given to guests who may be affected by this, and we will endeavour to keep disruption to a minimum.
- All personal data is collected and stored in accordance with the Data Protection Act 1998 (and any subsequent Acts that become law). We do not share data with any third parties except where we are required to do so by law or for the purposes of crime prevention.
Cancellation Policy
- You may cancel your booking up to 48 hours prior to check in time (3pm) on the day of your scheduled arrival without incurring any charges. If you cancel within this period, you will be charged the equivalent of your first night’s stay.
- For group bookings of 3 apartments or more, cancellations can be made up to 7 days prior to arrival without any charge. The first night’s stay will be charged in the event that a cancellation is made within this period.
- City Warehouse Apartments reserves the right, in circumstances arising which are beyond its reasonable control, to relocate guests in alternative accommodation of similar price, quality and location. Where this is not reasonably possible in the circumstances City Warehouse Apartments reserves the right to cancel your booking upon giving you reasonable notice.
